PUBLIC OFFER

PREAMBLE

1. 1. GENERAL PROVISIONS

   1.1. This Agreement is an official public offer (offer) of the NON-GOVERNMENTAL ORGANIZATION "UKRAINE IN COLOR" (hereinafter – the "Provider") to any natural or legal person (hereinafter – the "User").1.2. In accordance with Articles 633 and 641 of the Civil Code of Ukraine, the terms of this Agreement are the same for all Users.1.3. The full and unconditional acceptance of this Offer is the fact of the User making payment for a subscription on ukraineincolor.com.

2. 2. SUBJECT OF THE AGREEMENT

   2.1. The Provider grants the User access to a database of digital copies of works, a personal account, and specialized software (the "Software") under a paid subscription.2.2. The services are provided strictly for non-commercial use during the term of the paid subscription.

3. 3. PROCEDURE FOR SERVICE PROVISION

   3.1. Service provision starts from the moment the User creates a Personal account and the payment is confirmed.3.2. For the duration of the subscription, the User is granted access to the Platform's tools and the ability to obtain digital copies.3.3. Access to the Software is provided on an "as is" basis. The User does not obtain any rights to the source code, decompilation, or distribution of the Software.

4. 4. INTELLECTUAL PROPERTY RIGHTS

   4.1. All rights to the digital content and the Software belong to the Provider.4.2. Software ownership: the User confirms that they are not and do not become the owner of the Software. Only a temporary right to use the Software during the subscription term is granted.4.3. Commercial use: any use of the content or Software for profit without a separate license is prohibited. 5. 5. PAYMENT AND CANCELLATION

   5.1. Payment is made as 100% prepayment via the payment systems integrated on the Website.5.2. No refunds: since access to digital copies and the Software is granted immediately, funds for the already paid subscription period are non-refundable.5.3. Cancellation: the User may cancel the subscription at any time. No further payments will be charged, and the current subscription remains active until the end of the already paid term.

6. 6. RIGHTS AND OBLIGATIONS OF THE PARTIES

   6.1. The Provider undertakes to ensure access to the Platform's services after payment.6.2. The User undertakes to use the services personally and not to transfer access data to third parties.

7. 7. LIABILITY

   7.1. In case of copyright infringement or violation of the Software usage terms, the User is liable in accordance with the legislation of Ukraine.7.2. The Provider is not liable for technical failures on the side of the User's network and service providers.

8. 8. ELECTRONIC DOCUMENTS

   8.1. The Parties recognize the legal force of electronic messages (email) and payment system receipts as proper evidence of the fulfillment of obligations.

9. 9. TERM OF THE AGREEMENT

   9.1. The Agreement is effective from the moment of payment and remains in force until the end of the selected subscription term. The Provider may change the terms of this Offer by publishing updates on the Website.

10. 10. PERSONAL DATA PROCESSING

    10.1. The User consents to the processing of their personal data (full name, e-mail) in accordance with the Law of Ukraine "On Personal Data Protection" for the purpose of providing the Services.
